NON-REFUND, CANCELLATION & REFUND POLICY

1. Introduction :-

This Non-Refund, Cancellation & Refund Policy governs all course enrollments, training programs, LMS-enabled digital courses, employability training, career guidance, and placement assistance services offered by SEA Talent Management Private Limited under the brand name SEA of Success.

By registering for a course, making payment, or accessing the Company's learning platform or services, the learner acknowledges that they have been provided an opportunity to review the applicable course details, fee structure, service inclusions, eligibility requirements, and this Policy.

This Policy establishes the Company's terms regarding refunds, cancellations, payment disputes, and service-related complaints while protecting the legitimate commercial interests of the Company in accordance with applicable laws of India.

2. Nature of Services :-

SEA of Success provides structured training and career-development services that may include:

  • Access to digital learning materials through a Learning Management System (LMS).

  • Live classes, recorded sessions, and structured training modules.

  • Online assessments, writing tests, and mock interviews.

  • CV/resume preparation and professional communication training.

  • Career guidance and job application assistance.

  • Recruitment information and placement assistance, where included in the selected program.

The exact services, course duration, access period, and placement-support arrangements shall be determined by the description and terms of the particular program purchased by the Candidate.

Placement assistance, where offered, may be available for up to 90 days following successful course completion, subject to the applicable program terms and eligibility requirements.

Placement assistance is not a guarantee of employment, a specific salary, an interview, selection by an employer, or continued employment.

3. Non-Refund Policy :-

The course fee is charged for the selected training program and its applicable learning resources, training delivery, administrative arrangements, and other included services.

Once enrollment has been confirmed and course access, training, or any other included service has commenced, the fees shall generally be non-refundable and the enrollment shall not be cancellable at the Candidate's unilateral request, subject to applicable law and the exceptions specified in this Policy.

The Candidate acknowledges that the Company may allocate resources, activate digital access, arrange training, provide learning materials, and undertake administrative activities upon enrollment.

Accordingly, the following circumstances shall not, by themselves, entitle a Candidate to a refund:

a. Change of mind after enrollment or payment.

b. Failure to attend classes, access the LMS, or use the available learning resources.

c. Discontinuation, withdrawal, or incomplete participation in the course.

d. Failure to complete assignments, assessments, or other course requirements.

e. Personal, family, financial, educational, or professional circumstances affecting participation.

f. Dissatisfaction arising solely from changed personal preferences or career plans after the services have commenced.

g. Failure to secure employment within the applicable placement-support period.

h. Refusal of an interview, job offer, or employment opportunity.

i. Resignation from or discontinuation of employment after joining an employer.

j. Dissatisfaction with an employer's working conditions, location, salary, working hours, or other employment terms disclosed by the employer.

k. Failure to utilize the placement assistance or other services included in the selected program.

The above provisions do not exclude a refund or other remedy where required by applicable law, including in cases of verified payment errors, unauthorized transactions, or substantiated failures to deliver material services as agreed.

4. Refund Claims After Course Completion :-

Successful completion of a course does not, by itself, create an entitlement to recover the course fee.

Where the Candidate has completed the prescribed course, accessed the learning resources, participated in training, undertaken assessments, or received the services included in the selected program, a subsequent refund request based solely on a change of mind, personal dissatisfaction, or changed career plans shall not ordinarily be accepted.

The Company may verify the course status, attendance, LMS access records, assessment results, completion records, and relevant communications when reviewing such a request.

A Candidate's subsequent decision that they no longer require the training or its benefits shall not automatically invalidate the original enrollment or the services already delivered.

5. Refund Claims After Placement Assistance or Employment :-

Placement assistance is intended to support a Candidate's employment preparation and access to relevant recruitment opportunities. It does not constitute a guarantee of selection or employment.

Where the Company has provided the agreed training and placement-related services, a refund shall not ordinarily be payable solely because the Candidate:

  • Receives placement assistance, an interview opportunity, or a job offer and subsequently changes their mind.

  • Declines an employment opportunity or chooses not to join an employer.

  • Joins an employer and later resigns or discontinues employment.

  • Becomes dissatisfied with employment conditions or changes their career plans.

  • Does not obtain the specific employment outcome they personally expected, despite the delivery of the contracted services.

The Candidate acknowledges that recruitment decisions and employment conditions may depend on the employer's requirements, the Candidate's qualifications and performance, vacancy availability, and other factors outside the Company's reasonable control.

Receipt of placement assistance or completion of the course does not, by itself, create a right to a refund. Any claim alleging a material failure to provide an expressly promised service shall be assessed on its merits and in accordance with applicable law.

6. Technical Issues and Access to Services :-

Candidates are responsible for maintaining a suitable device, compatible software, and a reliable internet connection to access online services.

Technical difficulties arising from the Candidate's device, internet connection, power supply, software configuration, or other circumstances outside the Company's reasonable control shall not, by themselves, entitle the Candidate to a refund.

Where a technical issue is attributable to the Company, the Candidate should notify the support team so that the issue can be investigated and reasonable corrective action can be considered.

Nothing in this section limits any remedy required under applicable law.

7. Payment Errors and Duplicate Transactions :-

The Company will review genuine claims involving duplicate payments, erroneous charges, unsuccessful transactions where the amount was debited, or unauthorized transactions.

Candidates should submit the payment reference number, transaction date, amount, registered contact details, and supporting evidence to the official support email.

Following verification, the Company will take appropriate action in accordance with applicable law and the relevant payment service provider's procedures.

This provision does not create a general right to cancel a completed enrollment or obtain a refund merely because the Candidate no longer wishes to participate.

8. Cancellation or Non-Delivery by the Company :-

If the Company cancels a program before service delivery begins, is unable to provide a material service expressly included in the enrollment, or otherwise fails to fulfil a material contractual obligation, the matter shall be reviewed in accordance with the applicable enrollment terms and law.

Depending on the circumstances, an appropriate remedy may include rescheduling, an alternative service, transfer to another batch, or a refund where required by law or otherwise applicable.

Nothing in this Policy authorizes the Company to retain fees where such retention would violate applicable law.

9. Complaints, Disputes and Verification :-

The Company recognizes the right of Candidates to raise genuine complaints through appropriate channels. However, the submission of a complaint, allegation, payment dispute, or refund demand does not, by itself, establish an entitlement to a refund or prove that the Company has failed to fulfil its obligations.

Where a dispute arises, the Company may review relevant records, including:

  • Enrollment forms and accepted policy terms.

  • Payment receipts, invoices, and transaction records.

  • LMS activation, access, attendance, and course-completion records.

  • Assessment results and participation records.

  • Emails, messages, support tickets, and other relevant correspondence.

  • Placement assistance records and recruitment-related communications.

  • Other relevant and lawfully obtained evidence.

Where an allegation is inconsistent with the available records, the Company may submit a factual response with supporting documentation to the relevant payment provider, consumer authority, platform, law-enforcement authority, or other competent forum, as appropriate.

The Company reserves all rights and remedies available under applicable law in response to demonstrably false statements, fraud, deliberate misrepresentation, or other unlawful conduct.

Nothing in this Policy prohibits a Candidate from making a genuine complaint or restricts the lawful powers of any competent authority.

10. Record Retention and Evidence :-

For legitimate business purposes, service verification, complaint handling, legal compliance, and dispute resolution, the Company may maintain relevant records for a reasonable period in accordance with applicable law and its record-retention practices.

Such records may include enrollment confirmations, accepted policy versions, payment records, LMS activity, attendance, assessment results, course-completion information, placement communications, and complaint correspondence.

Where a dispute arises, the Company may rely on relevant records to explain the services provided and respond to the allegations, subject to applicable privacy, data-protection, confidentiality, and evidentiary requirements.

11. Chargebacks and Payment Disputes :-

Candidates are encouraged to contact the Company regarding genuine payment concerns so that the matter can be reviewed.

Where a chargeback or payment dispute is initiated, the Company may submit relevant enrollment records, payment confirmations, accepted terms, and evidence of service delivery to the relevant payment gateway, bank, or competent entity, as permitted by law.

The Company reserves the right to contest a payment dispute where the available evidence supports its position.

Nothing in this section restricts a Candidate's lawful right to dispute an unauthorized transaction or exercise other rights available under applicable law.

12. Refund Request and Grievance Procedure :-

Candidates seeking assistance regarding a payment, enrollment, or service-related issue should contact the Company at its official support email.

Requests should include:

  1. Candidate's full name and registered contact details.

  2. Course or program name.

  3. Enrollment or application reference number, where available.

  4. Payment date, amount, and transaction reference.

  5. A clear description of the issue and the remedy requested.

  6. Relevant supporting documents or communications.

The Company may request additional information where reasonably necessary to verify the claim.

Complaints shall be acknowledged and handled in accordance with applicable legal requirements and the Company's grievance-handling procedures. Where the law prescribes a particular response or resolution period, the applicable statutory timeline shall prevail.

Submitting a complaint or refund request does not automatically establish eligibility for reimbursement.

13. Candidate Acknowledgment and Acceptance :-

Before completing enrollment and payment, Candidates should review the applicable course description, fee structure, eligibility requirements, included services, placement-support terms, and this Policy.

The Company may obtain affirmative acceptance through an enrollment form, a checkbox, a signed declaration, or another appropriate method and retain the relevant record.

By accepting the Policy, the Candidate acknowledges that:

  • The course fee is generally non-refundable once enrollment is confirmed and course access or service delivery has commenced, subject to applicable law.

  • Non-participation, discontinuation, or a subsequent change of mind does not automatically entitle the Candidate to a refund.

  • Placement assistance does not guarantee employment or a specific employment outcome.

  • A subsequent employment decision does not, by itself, entitle the Candidate to a refund where the contracted services have been delivered.

  • Genuine payment errors and legally recognized claims will be assessed in accordance with applicable requirements.

14. Amendments and Applicable Law :-

The Company may revise this Policy from time to time to reflect changes in its services, business practices, or legal obligations. The applicable version and effective date shall be published or otherwise communicated through appropriate channels.

No amendment shall retrospectively remove rights or remedies that have already accrued under applicable law or the terms governing an existing enrollment.

This Policy shall be interpreted in accordance with the laws of India. Disputes shall be addressed through the applicable grievance mechanism and the competent forum having jurisdiction under applicable law.

Nothing in this Policy excludes or limits any statutory right or remedy that cannot lawfully be excluded or restricted by contract.
